An initial payment doesn’t have to be the final payment. For eligible out-of-network claims, Davner handles negotiation and federal independent dispute resolution, keeping your team informed throughout.
Underpaid claims can be worth disputing
When a plan and an out-of-network provider can’t agree on a rate, a certified IDR entity picks one side’s offer. In the latest federal data, it picked the provider’s in 85% of decisions. For emergency department visits, the median federal IDR award was 3.3x the plan’s benchmark.

Recovering payment takes more than filing a dispute.
Your team has to check eligibility, meet filing deadlines, and follow up until payment arrives, alongside its everyday billing work.
Which claims qualify?
Not every out-of-network claim can go through federal IDR. Each claim needs to be checked before filing.
Deadlines leave little room.
Negotiation and filing have strict windows. Someone needs to track each claim and move it forward on time.
An award still needs collecting.
A favorable decision is another step in the process. Payment needs to be followed up, checked, and matched to the claim.

We take it from there.
Davner reads every remittance, opens negotiation with the plan, files in the federal IDR portal, argues your offer before the IDR entity, and follows the award until it’s paid. Your team sees every dispute and every dollar.

Independent dispute resolution questions
What is independent dispute resolution (IDR)?
IDR is the federal arbitration process the No Surprises Act created for out-of-network payment disputes. When a provider and a health plan can’t agree on a rate during 30 business days of open negotiation, either side can file. A certified IDR entity reviews both offers and picks one, and the plan must pay within 30 calendar days.
Which claims qualify?
Out-of-network emergency care, non-emergency care from out-of-network clinicians at in-network hospitals and ambulatory surgery centers, and air ambulance services, under plans the federal process covers. Claims governed by a specified state law or an all-payer model agreement go through the state process instead. Davner checks every claim before anything is filed.
What do you need from us?
Your EOBs and remittances, whether paper, PDF, or 835 files from your clearinghouse, and access to the claim details behind them. We’ll ask you to sign an authorization for Davner to represent you in negotiation and IDR. There’s nothing to install.
How much does it cost?
Nothing up front. Davner fronts the federal fees on every dispute (the $15 administrative fee per party and the IDR entity fee) and takes a percentage of what’s collected above the plan’s initial payment. If nothing is collected, there’s no fee. Your agreement spells out how fronted fees are settled.
How long does a dispute take?
Open negotiation runs 30 business days, and many disputes settle there. If it doesn’t, the dispute is filed within 4 business days and the IDR entity has 30 business days from its selection to decide; in the second half of 2025, 62% of determinations came within that window. The plan then has 30 calendar days to pay.
Will disputing hurt our relationships with plans?
IDR is a routine part of out-of-network billing: more than 1.3 million disputes were filed in the second half of 2025 alone. Davner files only claims that qualify and keeps every exchange professional, which is the fastest way to a fair rate and the best way to keep a working relationship.
What if the plan doesn’t pay after we win?
Davner matches every determination against the payments that arrive. If a plan misses the 30-day deadline or pays short, we follow up and escalate to the federal agencies when needed.
Can you work alongside our billing company?
Yes. Most practices keep their billing company or revenue cycle team for everything else. Davner takes the out-of-network underpayments they flag, or finds them from your remittances, and reports results back in the format your team already uses.
Is our data secure?
Davner is SOC 2 and HIPAA compliant and signs a business associate agreement with every customer. Our Trust Center lists our controls and subprocessors.
